OCTOBER 6, 2010
A Closed Session/Special Meeting of the Livingston City Council was held on October 6, 2010, in the City Council Chambers with Mayor Espinoza presiding.
CALL TO ORDER
Mayor Espinoza called the meeting to order at 6:00 p.m.

CHANGES TO THE AGENDA
None.
CITIZEN COMMENTS
Community Development Director Donna Kenney shared a memorandum that she had given to the Council and City Attorney. Ms. Kenney gave an overview of her education and in her professional opinion of the City organization noted that she appreciated the expertise of City Manager Richard Warne and the difficulty of his job.
Kathryn Schell-Rodriguez, P.O. Box 163, Livingston finished reading the memorandum prepared by Donna Kenney. The memorandum went on to address the amount of funding and grants that have come into the City under Mr. Warne’s leadership. In addition there are facilities and equipment now available because of his diligence and hard work.
Myra Bettencourt, 1684 Duke Drive commented on the respect City staff had for the City Manager. Ms. Bettencourt stated that Mr. Warne did not bow down and did things ethically and legally. She expressed her concern that the current Council was working towards removing the City Manager.
Kaye Greeley, 1571 Monte Cristo Way stated that she was ashamed of the Council because they react without thinking logically. She cautioned the Council to think before they act.
Estella Martinez, P.O. Box 381, Livingston noted it was a shame that the current Council was behaving the way they were. She stated the Council should leave their personal agenda out of this and think intelligently before taking any action.
Mario Mendoza, no address given, stated that things should never have escalated to this level and he felt that Mr. Warne never listened to the community.
Elias Maldonado, no address given, thanked everyone for voting for the current Council. He stated that change was needed.
DISCUSSION AND POTENTIAL ACTION ITEMS
- Appointment of Labor Negotiators: Jose M. Sanchez, Interim City Attorney and Adam U. Lindgren, Special Counsel Relating to Employment Agreement with Unrepresented Employee: City Manager.
Motion: M/S Espinoza/Land to appoint Labor Negotiators Jose M. Sanchez and Adam U. Lindgren. The motion carried 4-0 by the following vote:
AYES: Council Members: Aguilar, Espinoza, Land, Urnberg
NOES: Council Members: None
ABSENT: Council Members: Vierra
CLOSED SESSION:
The Council adjourned to the City Hall Conference Room for a Closed Session at 6:30 p.m.
OPEN SESSION
The Council came out of Closed Session and into Open Session at 8:19 p.m.

ADJOURNMENT
The meeting was adjourned by consensus at 8:20 p.m.
