RECOMMENDATION:
City Council to provide staff direction for appointment to the Utility Rates Stakeholders Committee.
BACKGROUND AND DISCUSSION:
At their regular meeting of February 15, 2011, the City Council directed staff to advertise for volunteers for the Utility Rates Stakeholders Committee. An invitation to participate was sent out to the community at large, Foster Farms, Livingston Union School District, and Merced Union High School District. When the deadline of March 4, 2011 was reached, staff had received letters of interest from Foster Farms, Livingston Union School District, Merced Union High School District, and five members of the community (Claire A. Gehrman, Katherine Schell-Rodriguez, Pamela M. Tamez, Mike Torres, and Warren Urnberg). At the regular meeting of April 5, 2011, City Council appointed the Foster Farms and School District representatives and Claire A. Gehrman and Warren Urnberg from the community at large. Staff was then requested to re-advertise for someone to represent the commercial business owners in town. As of the date of this report, April 29, 2011, only one commercial business owner has asked to be on the Committee, Albert Arias of Napa Auto Parts on Main Street. City Council has options: appoint Mr. Arias or re-advertise to attract more applicants.

RESOLUTION NO. 2011-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON
APPOINTING UTILITY RATES STAKEHOLDERS COMMITTEE MEMBERS
WHEREAS, the City Council at their regular meeting of February 15, 2011 directed staff to
advertise and accept applications for volunteers for the Utility Rates Stakeholders Committee;
and
WHEREAS, the City Council at their regular meeting of April 5, 2011 appointed five Committee members and directed staff to re-advertise and accept applications for commercial business owner volunteers for the Utility Rates Stakeholders Committee; and
WHEREAS, staff received one new letter of interest from Albert Arias, owner of Napa Auto Parts on Main Street; and
WHEREAS, the City Council reviewed this interest letter at their regular meeting of May 3, 2011 and held public comment; and
WHEREAS, the City Council desires to appoint Mr. Arias to represent the commercial business owners in the community; and
WHEREAS, this action is ministerial and not subject to the California Environmental Quality Act (CEQA).
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Livingston does hereby appoint Albert Arias (in bold and italics) to the Utility Rates Stakeholders Committee below to represent Commercial Business:
