MAY 18, 2011
A Closed Session/Special Meeting of the Livingston City Council was held on May 18, 2011, in the City Council Chambers with Mayor Espinoza presiding.
CLOSED SESSION
CALL TO ORDER
Mayor Espinoza opened the meeting at 5:04 p.m.
PLEDGE OF ALLEGIANCE
The pledge of allegiance to the flag was recited.

CHANGES TO THE AGENDA
There were no changes to the agenda.
CITIZEN COMMENTS
Katherine Schell Rodriquez, P.O. Box 163 expressed concern that during the process of appointing a new City Manager, the Council was using the City Attorney to negotiate. She voiced concern over the cost of using an attorney for this purpose.
City Attorney Sanchez stated this was typical in the process of hiring a City Manager.
Council Member Samra noted that the City had always used the City Attorney in the past to negotiate the City Manager’s contract. Mr. Samra also stated that he did not feel the Council had the ability to write the contract.
Mayor Espinoza agreed with Council Member Samra. He commented that the City Attorney is the expert in this area.
DISCUSSION AND POTENTIAL ACTION ITEMS
- Appointment of Labor Negotiator: City Attorney Jose M. Sanchez.: Unrepresented Employee: City Manager.
Motion: M/S Samra/Aguilar to appoint City Attorney Jose M. Sanchez as the Labor Negotiator in the hiring of a new City Manager. The motion carried 5-0 by the following roll call vote:
AYES: Council Members: Aguilar, Espinoza, Land, Samra, Vierra
NOES: Council Members: None
ABSENT: Council Members: None
CLOSED SESSION
The Council subsequently adjourned to the City Hall Conference Room for Closed Session to discuss the following matters:

OPEN SESSION
The Council came out of Closed Session and into Open Session and returned to the City Council Chambers for the Special Meeting at 7:54 p.m.

ADJOURNMENT
The meeting was adjourned by consensus at 7:55 p.m.

As of this moment, we do not even know who the finalists for the City Manager Position are. City Manager Appointment in listed under Closed Session for the June 07th City Council Meeting. We won’t know if it is another “no reportable action” or “we have selected so-and-so” until they report out of Closed Session.
Given that the Acting City Manager has already said she plans on retiring in Mid-July, the Council really doesn’t have a whole lot of “wiggle room”. Unless they plan on convincing the Acting City Manager/Finance Director to stick around for a while longer….
