A Special Meeting of the Livingston City Council was held on April 14, 2015, in the City Council Chambers with Mayor Espinoza presiding.
CALL TO ORDER
Mayor Espinoza called the meeting to order at 6:21p.m.

The pledge of allegiance to the flag was recited.
CHANGES TO THE AGENDA
Mayor Espinoza opened and closed Citizen Comments at 6:23 p.m. as there were no comments from the audience.
DISCUSSION AND POTENTIAL ACTION ITEMS
1. Resolution 2015-16 Approving a Memorandum of Understanding with Foster Farms to Repair the Submersible Pump at Well #14 and Making Findings Explaining Why Public Bidding is Not Required for this Project.
City Engineer Gouveia introduced this item. He announced that the public bidding process for this item should be waived due to its urgent nature.
City Attorney Sanchez mentioned that City funds may not be used for this project, as Foster Farms will be providing repairs. He cited Public Contract Code Section 20168 and explained how that code applies to this item. Water related items such as this should be treated urgently as we are currently in a drought.
Mayor Espinoza opened and closed Public Comments at 6:30 p.m. as there were no comments from the audience.
Mayor Espinoza announced that he appreciates Foster Farms’ cooperation with this project.
Mayor Pro-Tem Samra noted that this item is in regards to health and safety. Water production is critical in every community, especially when fire fighters need water during fire emergencies.
Council Members Soria and Sicairos thanked Foster Farms for collaborating with the City of Livingston.
Motion: M/S Samra/Sicairos to adopt Resolution No. 2015-16, Approving a Memorandum of Understanding with Foster Farms to Repair the Submersible Pump at Well #14 and Making Findings Explaining Why Public Bidding is Not Required for this Project. The motion carried
4-0 by the following roll call vote:

NOES: Council Members: None
ABSENT: Council Members: Mendoza
