CLOSED SESSION/REGULAR MEETING

LIVINGSTON CITY COUNCIL

JUNE 16, 2015

A Closed Session/Regular Meeting of the Livingston City Council was held on June 16, 2015, in the City Council Chambers with Mayor Espinoza presiding.

CALL TO ORDER

Mayor Espinoza called the meeting to order at 6:12 p.m.

Mayor Espinoza opened and subsequently closed Citizen Comments at 6:14 p.m., as there were no comments from the public.

CLOSED SESSION

Mayor Espinoza opened the meeting for public comments at 6:15 p.m. There were no comments and the Council went into Closed Session immediately thereafter to discuss the following matters:

1. Conference with Legal Counsel – Potential Litigation

Mayor Espinoza called the meeting to order at 7:06 p.m.

AWARDS, PRESENTATIONS AND PROCLAMATIONS

1. Color Guard by Livingston Police Explorer Post 518.

2. Invocation by Police Chaplain Mike Outten.

3. Oath of Office for Newly Appointed Council Member Alex McCabe by City Clerk

Tony Silva.

4. Introduction and Swearing in of New Police Officer Kamalpreet “Kenny” Gill and Reserve Police Officer Sergio Valencia by Police Lieutenant Chris Soria. Oath of Office by City Clerk Tony Silva.

Mayor Espinoza and City Clerk Silva introduced items number one through four. City Council took a break from 7:30 p.m. to 7:36 p.m., so that the public could take photographs with newly appointed Council Member McCabe and newly hired Police Officer Gill.

ANNOUNCEMENTS AND REPORTS

Supervisor John Pedrozo Announcements and Reports.

None.

City Staff Announcements and Reports.

Randy Johnson, Contract Public Works Director, reported that Well #9 is being adjusted for sand filters, Well #11 is being adjusted for dual filters, and Well #14 is being modified to upgrade the existing pump. Moreover, he added that barbecue grills, shade structures, and other amenities are being installed at Gallo Park.

Mayor Pro-Tem Samra and Mayor Espinoza reported that City-owned parks and landscaped areas need additional maintenance. Discussion followed.

City Manager Announcements and Reports.

Interim City Manager Ortiz reported that the City’s street sweeper should soon be operating again.

City Council Members’ Announcements and Reports.

Council Member Soria congratulated newly appointed Council Member McCabe.

Council Member Sicairos thanked the Parks and Recreation Department for organizing summer programs.

Council Member McCabe thanked the City Council for appointing him. Moreover, he encouraged the public to participate in fundraisers for the 4th of July Festival and to attend the Downtown Open Market for family fun.

Mayor Pro-Tem Samra reported that the water fountain at City Hall is not operating properly. He recommends that City staff have the water fountain inspected and fixed. In addition, he welcomed newly appointed Council Member McCabe.

Mayor’s Announcements and Reports.

Mayor Espinoza congratulated Council Member McCabe and challenged the City Council to raise funds for a shade structure at the park in the downtown across from City Hall.

CITIZEN COMMENTS

Mayor Espinoza opened Citizen Comments at 7:48 p.m.

Katherine Schell-Rodriguez, P.O. Box 163, congratulated newly appointed Council Member McCabe. She proceeded by asking the following questions:

1) Will there be additional interviews for the position of City Manager?

2) Are there businesses that want outdoor seating?

3) Will there be additional Special City Council Meetings?

Mayor Espinoza replied that there will be more interviews for the position of City Manager.

City Attorney Sanchez added that there will be additional interviews this Saturday. Saturdays are good days to interview because that is when most candidates are available. In regards to restaurant encroachment permits, that’s based on demand and Planning Staff does not have that information.

Katherine Schell, P.O. Box 163, asked why negotiations with labor unions have been delayed.

Interim City Manager Ortiz replied that negotiations have been delayed because City Hall is short staffed and has been focused on other items, even though this is an important item. Negotiations should begin soon.

Mayor Espinoza closed Citizens Comments at 8:05 p.m. as there were no further public comments.

CONSENT CALENDAR

5. Resolution No. 2015-30 Authorizing the Interim City Manager to Continue Making Required Expenditures to Meet Current or Immediate Financial Obligations Until the 2015/16 Fiscal Year Budget is Adopted.

6. Approval of Minutes of Meeting Held on May 26, 2015.

7. Approval of Minutes of Meeting Held on May 28, 2015.

8. Approval of Warrant Register, Dated June 11, 2015.

Mayor Espinoza had questions about a warrant for the Pentecost Hall. He would like staff to follow-up with additional information about this warrant.

Motion: M/S Samra/Sicairos to approve the Consent Calendar. The motion carried 5-0 by the following roll call vote:

DISCUSSION AND POTENTIAL ACTION ITEMS

9. Appointment of Alternate Member to Central Valley Division League of California Cities Executive Committee.

Mayor Espinoza introduced this item.

Mayor Espinoza opened and closed Public Comments at 8:08 p.m., as there were no comments from the public.

Motion: M/S Samra/Sicairos to approve the appointment of Council Member McCabe as Alternate Member to the Central Valley Division League of California Cities Executive Committee. The motion carried 5-0 by the following roll call vote:

AYES: Council Members: McCabe, Sicairos, Soria, Samra, Espinoza

NOES: Council Members: None

ABSENT: Council Members: None

10. General Budget Workshop – FY2015-2016 Budget – Capital Improvements.

Interim City Manager Ortiz provided a budget workshop.

Mayor Espinoza opened Public Comments at 8:19 p.m.

Katherine Schell-Rodriguez, P.O. Box 163, mentioned that many of the street lights in the downtown are not operating effectively. She asked if they will be fixed or replaced soon.

Interim City Manager Ortiz replied that street lights are replaced on a complaint basis and are generally fixed quickly. In the future, the City would like to install LED lights that are more cost effective and provide more illumination.

Mayor Espinoza closed Public Comments at 8:24 p.m. as there were no further comments from the public.

CLOSED SESSION (continued)

The City Council returned to Closed Session at approximately 8:25 p.m.

OPEN SESSION

The Council came out of Closed Session and into Open Session at 8:57 p.m. There was no reportable action.

ADJOURNMENT

The meeting was adjourned by consensus at approximately 8:58 p.m.
