AGENDA ITEM: Resolution Accepting Completion of the Joseph Gallo Park Improvements, and Authorizing the City Clerk to Record a Notice of Completion With Merced County.

RECOMMENDATION:

1. Accept the work as complete.

2. Authorize the City Clerk to record a Notice of Completion with Merced County.

3. Authorize the Interim City Manager to release Payment and Performance Bonds for the project following the expiration of35 days from the date of recordation of the Notice of Completion.

4. Authorize the Interim City Manager to make final payment of retention monies to Marko Construction Group, Inc. immediately following recordation of the Notice of Completion. The City must pay Contractor retention before the grant deadline of March 31, 2015 for reimbursement of project expenses.

BACKGROUND:

The City of Livingston advertised the Joseph Gallo Park Improvements Project on October 22, 2014 and received a total of six bids for this project. Marko Construction Group, Inc. submitted the lowest bid and was awarded a contract for $261,613.91.

DISCUSSION:

The project’s construction phase started in January 2015 and the major work consisted of installing playground equipment, constructing 3 picnic patios, constructing a restroom, and planting thirteen (13) 24" box trees in the City of Livingston.

The Contractor completed all work within the time required by the Contract Documents. The project was successfully completed as per the approved plans and specifications.

Final inspection has been performed and the work will be found complete contingent on Marko Construction Group, Inc. completing all Punch List items. Therefore, the work should be accepted as complete and a Notice of Completion filed. If no claims are filed within 35 days after recordation, the Payment and Performance Bond should be released. Retention in the amount of $13,080.69 should be paid to Marko Construction Group, Inc. immediately following recordation of the Notice of Completion.

FISCAL IMPACT:

The final construction contract and City-furnished equipment cost inclusive of all authorized work was $354,777.79.

Funding for this contract was through the Roberti-Z’Berg-Harris Nonurbanized Area Need­ Basis Grant Program Project No. RN-24-00lA at 100% reimbursement not to exceed the programmed amount of $477,422.00.

RESOLUTION NO. 2015-

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON FOR THE ACCEPTANCE OF THE JOSEPH GALLO PARK IMPROVEMENTS

AUTHORIZING THE CITY CLERK TO RECORD A NOTICE OF COMPLETION WITH MERCED COUNTY AND AUTHORIZING THE INTERIM CITY MANAGER TO RELEASE PAYMENT AND PERFORMANCE BONDS AND TO MAKE FINAL PAYMENT OF RETENTION MONIES TO MARKO CONSTRUCTION GROUP, INC.

WHEREAS, the City advertised the Project on October 22, 2014; and

WHEREAS, the City received and the Deputy City Clerk publicly opened bids on November 12, 2014; and

WHEREAS, the City Council awarded a contract to Marko Construction Group, Inc. in the amount of $261,613.91 for the installation of playground equipment, construction of 3 picnic patios, a restroom, and planting thirteen 24" box trees on November 13, 2014; and

WHEREAS, the Public Works Department and City Engineer have completed a final inspection of the Project and recommends final acceptance; and

WHEREAS, upon approval of the final acceptance of the Project by the City Council, the City Clerk will record a Notice of Completion with Merced County and the Interim City Manager will release Performance and Payment Bonds after the normal 35 day appeal period and retention monies due the Contractor shall be paid immediately following recordation.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Livingston hereby:

1. Adopts a Resolution to accept the Joseph Gallo Park Improvements project.

2. Authorizes the City Clerk to record a Notice of Completion with Merced County.

3. Authorizes the Interim City Manager to release Performance and Payment Bonds after the normal 35 day appeal period and to make final payment of retention monies to Marko Construction Group, Inc. immediately following recordation.
