RECOMMENDATION:

Adopt Resolution No. 2016- , authorizing the Interim City Manager to execute a six (6) month professional services agreement with James Fructuoso to provide professional administrative support services.

BACKGROUND:

The City Manager position has been vacant for over a year, creating a need for the Assistant City Manager/Finance Director to absorb additional duties in efforts to continue normal operations. Due to recent transitions in management position(s), there’s a high need for temporary administrative support in admin/finance areas. This temporary support is much needed to fulfill the upcoming deadlines and priorities such as the 2016-17 fiscal year operating budget, preparedness for year-end and new-year, annual audit, review and update of administrative policies and other especial projects.

Mr. Fructuoso is an excellent candidate to provide support in the above areas. Mr. Fructuoso has a great deal of experience with budgets; financial reviews, management and reporting; general accounting functions, grant reporting and auditing. His experience and knowledge will definitely assist with supervision of accounting functions.

DISCUSSION:

Approval of a six (6) month professional services agreement with James Fructuoso to provide professional administrative support services.

FISCAL IMPACT:

A six (6) month expenditure limit of $55,000 or $9, 166 average per month based on an hourly rate of $75 for a 24 hour week schedule. Services are to be funded by general fund, enterprise funds (water, sewer, sanitation) and other special revenues funds. The possible cost allocation could be as follows; 20% to general fund, 25% to water and sewer, 10% to sanitation, 10% Gas Tax, and 10% to Special Districts.

RESOLUTION NO. 2016-

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING AND AUTHORIZING THE INTERIM CITY MANAGER

TO EXECUTE A SIX (6) MONTH PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF LIVINGSTON AND JAMES FRUCTUOSO

WHEREAS, the City of Livingston is currently facing critical transitions in key management positions creating an immediate need for temporary administrative support; and

WHEREAS, James Fructuoso has agreed to provide proper administrative support services in the finance/accounting areas; and

WHEREAS, James Fructuoso has the relevant accounting/finance experience meeting City’s immediate needs; and

WHEREAS, management recommends retaining Mr. Fructuoso with a six (6) month expenditure limit cost of $55,000 or $75 per hour for up to 24 weekly hours; and

WHEREAS, the City Council wishes to approve a Professional Services Agreement with an initial term ending on October 5th, 2016.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston hereby adopts a Resolution to approve a six (6) month Professional Services Agreement with James Fructuoso to provide administrative support and authorizes the Interim City Manager to execute agreement in a form approved by the City Attorney.
