LIVINGSTON CITY COUNCIL

DECEMBER 20, 2016

A Regular Meeting of the Livingston City Council was held on December 20, 2016, in the City Council Chambers with Mayor Soria presiding.

REGULAR MEETING

Mayor Soria called the meeting to order at 7:02 p.m.

PLEDGE OF ALLEGIANCE

The pledge of allegiance to the flag was recited.

CHANGES TO THE AGENDA

Mayor Soria noted that Deacon Montejano had some unforeseen scheduling conflicts and will not be participating in the Invocation of new Council Members.

CONFIRMATION OF CANVASS OF MUNICIPAL ELECTION

1. Resolution of the City Council of the City of Livingston Confirming the Canvass by the Merced County Clerk of the Results of the General Municipal Election of November 8, 2016, Held in and for the City of Livingston and Declaring the Results of Said Election.

Interim City Manager Ortiz introduced this item.

Motion: M/S Soria/Aguilar to adopt Resolution No. 2016-67 of the City Council of the City of Livingston Confirming the Canvass by the Merced County Clerk of the Results of the General Municipal Election of November 8, 2016, Held in and for the City of Livingston and Declaring the Results of Said Election. The motion carried 4-0-1 by the following roll call vote:

AYES: Council Members: Aguilar, Sicairos, Samra, Soria

NOES: Council Members: None

ABSENT: Council Members: Vacant Seat

INVOCATION

2. Alberto Montejano, Deacon, Saint Mary of the Apostles Roman Catholic Church, Fresno, and Priest from Guru Nanak Sikh Temple, Livingston.

An invocation was provided by Police Chaplain Mike Outten and the Priest from Guru Nanak Sikh Temple.

OATHS OF OFFICE

3. City Clerk will administer the Oaths of Office to Mayor-elect, Council Members-elect, and City Treasurer-elect.

City Clerk Silva administered the Oath of Office to Mayor-elect Jim Soria; Council Members-elect Juan Aguilar and Arturo Sicairos; and City Treasurer-elect Maria Ribeiro. City officials recognized their families and took photographs with the community and City staff

4. Deputy City Clerk will administer the Oath of Office to City Clerk-elect Antonio Silva.

Mayor Soria administered the Oath of Office to City Clerk-elect Silva.

CITY COUNCIL REORGANIZATION

5. Nomination and Election of Mayor Pro-Tempore.

Mayor Soria nominated Council Member Samra for the position of Mayor Pro-Tempore. He commended his experience and skills as being good assets for the position.

Motion: M/S Soria/Aguilar to appoint Council Member Samra as Mayor Pro-Tempore. The motion carried 4-0-1 by the following roll call vote:

AYES: Council Members: Aguilar, Sicairos, Samra, Soria

NOES: Council Members: None

ABSENT: Council Members: Vacant Seat

6. Discuss and Make City Council Appointments to City Boards, Commissions and Committees:

a. Member/Alternate – Merced County Association of Governments (MCAG) Governing Board. (Currently: Mayor Espinoza, Member, Council Member Sicairos, Alternate).

b. Representative/Alternate – Central Valley Division League of California Cities. (Currently: Council Member Soria Representative, Council Member McCabe, Alternate).

c. Member/Alternate – Merced County Mosquito Abatement District Board of Directors. (Currently: Mayor Espinoza, Representative, No Designated Alternate).

d. Representative/Alternate – Special City Selection Committee of the San Joaquin Valley Air Pollution Control Board. (Currently: Mayor Espinoza, Representative, Council Member Sicairos, Alternate).

e. City Council Liaison – Livingston Planning Commission. (Currently: Council Member Sicairos).

City Council would like to postpone the appointments until after the vacant Council seat has been filler.

Former Council Member McCabe, recommends that someone be appointed (even on a temporary basis) to the Mosquito Abatement District Board of Directors, as there are many important items that will be discussed by the Board in January.

Motion: M/S Samra/Sicairos to appoint Mayor Soria as a temporary representative to the Mosquito Abatement District Board of Directors. The motion carried 4-0-1 by the following roll call vote:

AWARDS, PRESENTATIONS, PROCLAMATIONS

7. On behalf of the City Council, Mayor Soria/Mayor Pro-Tempore Samra presented a plaque of appreciation to out-going Mayor, Rodrigo Espinoza.

Representatives for Congressman Jim Costa also provided a plaque of appreciation to out-going Mayor Espinoza.

Out-going Mayor Espinoza thanked his family and City staff for all their support. Some of his highlights with the City include improving water quality, adopting the Downtown Beautification Project, and providing many community programs and events such as the Sweet Potato Festival and the weekly Downtown Open Market.

ANNOUNCEMENTS AND REPORTS

Supervisor Pedrozo Announcements and Reports.

City Staff Announcements and Reports.

Police Chief Chavez congratulated the new Council Members and Mayor.

City Manager Announcements and Reports.

Interim City Manager Ortiz congratulated the newly elected officials and wished the community a happy holiday season and new year.

City Council Members’ Announcements and Reports.

Council Member Aguilar thanked his family and everyone who voted for him. He hopes to use his knowledge and experience to improve the City and the quality of life for its residents.

Mayor Pro-Tem Samra would like City Council to discuss options for filling the vacated City Council seat during the next City Council meeting.

Mayor’s Announcements and Reports.

Mayor Soria announced that he looks forward to working with City Council and that he plans on having monthly “Coffee with the Mayor” sessions with the community. These sessions will take place on Saturdays at a designated restaurant or café.

PUBLIC HEARING

8. Waive the Second Reading and Adopt Ordinance No.628 of the City Council of the City of Livingston Repealing Ordinance No. 616 and Replacing Livingston Municipal Code, Title 4, Chapter 1, “Building Administration Codes” to Adopt and Amend the 2016 California Building Code, 2016 California Mechanical Code, 2015 International Property Maintenance Code, 2016 California Plumbing Code, 2016 California Electrical Code, 2016 California Code of Building Conservation, 2016 Energy Code, 2016 California Green Building Standards Code, and 2016 California Residential Building Code and all appendices attached thereto.

Contract City Planer Hatch introduced this item.

Mayor Soria opened the Public Hearing at 8:10 p.m.

Developer Dwight Larks asked if the new codes will impact development fees.

Contract City Planner Hatch replied that the new codes will not impact City development applications.

Mayor Soria closed the Public Hearing at 8:13 p.m., as there were no further comments from the public.

Mayor Soria opened and closed Citizen Comments at 8:17 p.m. as there were no comments from the public.

Motion: M/S Samra/Sicairos to approve the Consent Calendar. The motion carried 4-0-1 by the following roll call vote:

DISCUSSION AND POTENTIAL ACTION ITEMS

14. City Council Options for Filling of Council Vacancy

City Attorney Sanchez introduced this item. He noted that the vacancy should be filled within 60 days. The Council has various options to fill the vacancy. Said options include appointing someone, going through an interview selection process, or holding a special election.

Mayor Soria opened Public Comments at 8:31 p.m.

Dwight Larks asked if someone needs to be a resident of Livingston to be appointed.

City Attorney Sanchez replied yes.

Former Mayor Rodrigo Espinoza noted that a special election could cost thousands of dollars. He recommends that City Council appoint someone instead, for cost saving purposes.

Mayor Soria closed Public Comments at 8:32 p.m. as there were no further comments.

The City Council would like staff to reach out to candidates from the election to determine their r interest in filling the vacancy.

The meeting was adjourned by consensus at approximately 8:42 p.m.
