RECOMMENDATION:

City Council adopt Resolution No. 2016-_, a Resolution Authorizing the Interim City Manager to Execute the Program Supplement Agreement No. 011-Nl Administering Agency-State Agreement No. 10-5256R for the Sidewalk Infill Project on Stefani, White, Crowell, and Simpson: Federal Project No. CML-5256(016) and Authorizing the Interim City Manager to Act on Behalf of the City of Livingston.

BACKGROUND:

In January 2014, the City applied for funds to construct new sidewalks and wheelchair ramps at various locations on the North side of the City of Livingston (City). This is a "quality of life" project and a continuation of the CMAQ Pedestrian Improvement project that was completed in April, 2014. It focuses on the construction of sidewalks where there are still discontinuities in pedestrian facilities, hence providing connectivity and safe pedestrian access to schools, commercial areas, parks, churches, etc.

DISCUSSION:

The City of Livingston has received Federal Congestion Mitigation Air Quality (CMAQ) funds for the Sidewalk Infill Project on Stefani, White, Crowell, and Simpson. The City has received the Authorization to Proceed with Construction and Construction Engineering and Caltrans has sent the Program Supplemental Agreement No. 011-N l for execution.

The State of California, acting through Caltrans, is administering the CMAQ funds. These funds will be paid to the City of Livingston pursuant to the provisions of the Administering Agency­ State Agreement No. 10-5256R. In order to receive funds for a specific project, the City must execute a supplemental agreement that identifies the specific project and any special conditions.

The State requires the City to adopt a resolution that clearly identifies the project and the official authorized to execute the agreement. The attached resolution meets the requirements.

FISCAL IMPACT:

The Sidewalk Infill Project is funded by a combination of Federal and Local Funds. The total estimated project cost is $234,800. Adoption of the proposed resolution secures $207,868 of federal CMAQ funds with a required local match of $26,932.00. The Local Match is being provided by the City from their PDA and Gas Tax funds.

There is no impact to the General Fund.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE PROGRAM SUPPLEMENT AGREEMENT NO. 011-Nl TO ADMINISTERING AGENCY-STATE AGREEMENT NO. 10-5256R FOR FEDERAL PROJECT NO. CML-5256(016) (SIDEWALK INFILL ON STEFANI, WHITE, CROWELL, AND SIMPSON)

WHEREAS, the City of Livingston applied for and received grant funds under the Federal Program for Congestion Mitigation and Air Quality (CMAQ) to construct new sidewalks and wheelchair ramps at various locations on the North side of the City of Livingston; and

WHEREAS, the City of Livingston has received a request from the Department of Transportation to enter into Program Supplement Agreement No. 011-Nl Administering Agency-State Agreement No. 10-5256R for project No. CML-5256(016); and

WHEREAS, Caltrans requires the City to adopt a resolution that clearly identifies the project and the official authorized to execute the agreement.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby authorizes the Interim City Manager to execute Program Supplement Agreement No. 011-Nl to Administering Agency-State Agreement No. 10-5256R, and authorizes the Interim City Manager to act on behalf of the City of Livingston.
