AGENDA ITEM: Resolution Approving a Lease Agreement with Flor Chaves for the Lease of City-Owned Property Located at 641 Main Street

RECOMMENDATION:

Adopt Resolution No. 2016-_, approving a lease agreement with Flor Chaves for the lease of City­ owned property located at 641 Main Street.

BACKGROUND:

The City owns a building at 641 Main Street which includes land (APN: 024-145-011) that is the adjacent paved area and parking stalls that has been leased by Flor Chaves since April 2007 for the purpose of operating a taco truck, El Good Taco.

DISCUSSION:

Flor Chaves has expressed interest in continuing to lease the land from the City. The tenant shall use the land only for the permitted use. The terms of the two-year lease agreement includes monthly rent in the amount of seven hundred dollars ($700) plus utilities. The tenant will be responsible for maintaining the property including any and all improvements necessary to meet local and state regulations.

Staff recommends approval of the lease agreement and notes that leasing this property has proven to be cost-efficient because the costs of maintaining the property are paid for by the tenant.

FISCAL IMPACT:

Continuing to lease this property eliminates maintenance and repairs costs to the City, which is a cost savings. The rent generated by this Lease will be $8,400 per year.

RESOLUTION NO. 2016-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING A LEASE AGREEMENT WITH FLOR CHAVES FOR THE LEASE OF CITY-OWNED PROPERTY LOCATED AT 641 MAIN STREET AND AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE THE AGREEMENT

WHEREAS, the City owns certain property, a building, located at 641 Main Street which includes land (APN: 024-145-011) that is the adjacent paved area and parking lot; and

WHEREAS, the paved area and parking lot has been leased by Flor Chaves since April 2007 for the purpose of operating a taco truck, El Good Taco.

WHEREAS, Flor Chaves has expressed interest in continuing to lease the property from the City; and

WHEREAS, the terms of the proposed two-year lease agreement includes monthly rent in the amount of seven hundred dollars ($700) plus utilities; and

WHEREAS, the tenant will be responsible for maintaining the property including any and all improvements necessary to meet local and state regulations; and

WHEREAS, leasing this property is cost-effective because the cost to the City to maintain this property is greater than leasing it out to a private party to maintain.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston does hereby approve a lease agreement with Flor Chaves for lease of land at 641 Main Street and authorizes the Interim City Manager to execute the Agreement in a form approved by the City Attorney.
