RECOMMENDATION:

Staff recommends that City Council adopt Resolution No. 2016-_, approving the Annual Gann Appropriations Limit for the City of Livingston’s Fiscal Year 2016/2017.

BACKGROUND:

Revenue and Taxation Code Section 7910 requires each local government to establish its Appropriations Limit by resolution each year at a regularly scheduled meeting or a noticed public meeting.

In November 1979, the voters of the State of California approved Proposition 4, commonly known as the (Paul) Gann Initiative. The Proposition created Article XIII B of the State Constitution placing limits on the amount of revenues, which can be spent by all entities of government.

The limit is based on actual appropriations during the 1978/1979 Fiscal Year and increased each year using the growth of population and inflation.

FISCAL IMPACT:

Resolution No 2016-_ will set the City’s Gann Appropriation Limit at $4,855,248 for the Fiscal Year 2016/2017.

RESOLUTION NO. 2016-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON SETTING THE CITY OF LIVINGSTON’S GANN APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 2016/2017

WHEREAS, the people of California on November 6, 1979, added Article XIII-B to the State Constitution placing various limitations on the appropriations of state and local governments; and

WHEREAS, the State Legislature adopted Chapters 1205 and 1342 of the 1980 Statutes which implemented Article XIII-B; and

WHEREAS, the people of California on June 5, 1990 amended Article XIII-B effective July 1, 1990; and

WHEREAS, the provisions of the amendments have been interpreted by a coalition of statewide organizations, and the organizations have issued, through the League of California Cities, revised guidelines to calculate the appropriations limit; and

WHEREAS, Section 7910 of the Government Code requires cities to adopt a resolution setting the annual appropriations limit at a regularly scheduled meeting or a noticed special meeting; and

WHEREAS, the City of Livingston has complied with the provisions of Article XIII-B in calculating the Appropriations Limit for Fiscal Year 2016/2017.

NOW, THEREFORE, BE IT RESOLVED that:

1. The City Council of the City of Livingston hereby sets the Appropriations Limit from the proceeds of taxes, at $4,855,248 for the Fiscal Year 2016/2017, as per the attached Exhibit "A".

2. All resolutions and parts of resolutions in conflict herewith, including, but not necessarily limited to, such resolutions or parts of resolutions relating to the Appropriations Limit, as may be in conflict herewith are hereby expressly repealed.
