·         JANUARY 16, 2007

§         Resolution Approving Site Plan/Design Review 2006-10, for a New Two-Story 5,175 Square Foot Retail/Office Building on Main Street and Determining a Parking In-Lieu Fee for This Project.

§         Authorize the City of Livingston to accept the $50,000 National Park Service Land and Water Conservation Grant and the City Manager to Sign all Applicable Contracts and Documents to Secure Funding and Construct Park Improvements at the Livingston Sports Complex.

§         Presentation of Urban Water Management Plan.

§         Representatives of Carollo Engineers of Fresno gave a power point presentation on the 2005 Urban Water Management Plan for the City of Livingston.

§         Introduce and Waive the First Reading of an Ordinance of the City Council of the City of Livingston Amending Livingston Municipal Code (LMC) Section 5-6-5 (D) 2 Nonconforming Structures.

§         Presentation of Initial Study/Mitigated Negative Declaration for Livingston High School Master Plan.

§         Michael Belluomini, Director of Facilities Planning for the Merced Union High School District, made a verbal presentation regarding the Initial Study and Mitigated Negative Declaration for the Livingston High School Master Plan.

§        

·         MARCH 20, 2007

§          City of Livingston 2005 Urban Water Management Plan.

§         Tom Gracey, Carollo Engineering, was available to answer any questions regarding the Plan. 

§         City of Livingston Circulation/Traffic Draft Master Plan.

§         Ken Anderson, KD Anderson Associates, Inc. presented an in-depth overview of the plan.

§         Authorize the Joint Purchase with the Livingston Union School District of a 36X60 Portable Building for the Expansion of the After-School Program and City Recreation Programs.

§        

·         APRIL 03, 2007

§         City of Livingston Draft Circulation/Traffic Master Plan.    

§         Ken Anderson, representing KD Anderson and Associates, gave another presentation on the Draft Circulation/Traffic Master Plan.

§         Introduce and Waive the First Reading of an Ordinance of the City Council of the City of Livingston Approving Annexation and Prezone 2005-04 and Adopting by Resolution a Negative Declaration for the Blueberry Crossing Commercial Project.

§         Approval of Floor Plans and Elevations for Court Theater and Authorization to Prepare Architectural Drawings.

§        

·         APRIL 17, 2007

§         Valley Atwater Schelby School Mitigated Negative Declaration  

§         Lee Andersen, Superintendent of the Merced County Office of Education (MCOE), shared information regarding concerns with building a continuation school on Shelby School property.  Eric Dean, representing the MCOE, was also present to answer questions. 

§         Livingston Sports Complex Master Plan Approval. 

§        

·         MAY 01, 2007

·        Presentation by Seyed Sadredin, Executive Director, San Joaquin Valley Air Pollution Control Board.  

o       Mike Nelson, a member of the Merced County Board of Supervisors and a Board member of the San Joaquin Valley Air Pollution Control Board gave an in depth presentation on recently updated Board rules and regulations. 

§         Approval of the Financing Plan for the City Hall Expansion Project and Authorization To Go Out to Bid Once Tenants are relocated. 

§         Resolution Amending Section One: Residential Development of the Livingston Design Guide Concerning the Installation of Rooftop Equipment. 

§        

·         MAY 15, 2007         

§         Presentation by Livingston Rotary Club.

§         On behalf of the Livingston Rotary Club and Foster Farms, Woody Campini,  presented Mayor Samra with a check for $40,000 as a donation for the Memorial Park Improvement Project.

§         Discussion and Potential Action on Valley Atwater Schelby School.

§         Council Member Soria wanted to note for the record that he was not in agreement with this particular school being built on the proposed site because of safety concerns for students attending Schelby School.

§         Award of a Construction Contract for the Proposition 13 Water Line and Alleyway Paving Improvement Project.

§         City Engineer Gottiparthy presented the agenda item and presented a summary of bids received for this project.

§         Resolution Approving $543,000 for Environmental Studies for (1) Widening of Highway 99 from the Stanislaus County Line Through Livingston and (2) Improvements for the Winton Parkway and Hammatt Avenue Interchanges.

§         Discussion and Potential Action on Soccer Field Rentals.

§         Introduce and Waive the First Reading of An Ordinance Adopting a Description of the Livingston Community Redevelopment Agency’s Program for the Acquisition of Real Property by Eminent Domain in Conformance with the Requirements of California Health and Safety Code Section 33342.7.

§        

·         JUNE 05, 2007

§         Public Safety Camera System.

§         Police Chief Eldridge gave an in depth presentation on a proposal to implement a Citywide Video Camera System in an effort to deter crime in the community.  He also gave a power point presentation on the proposal.

§         Presentation by the Merced County Economic Development Corporation (MCEDCO)

§         Scott Galbraith and Jim Kanabay from the Merced County Economic Development Corporation (MCEDCO) informed the Council of what type of projects MCEDCO can provide to Livingston should the City decide to work with them. 

§         Distribution of Preliminary List of Street Rehabilitation Improvements.

§         List distributed to City Council to review for a future meeting.

§        

·         JUNE 19, 2007

§         Presentation of Water Enterprise Fund Financial and Water Rate Information.

§         Membership in Tree Foundation and Appointment of Board Member.

§         Introduce and Waive the First Reading of an Ordinance of the City Council of the City of Livingston Adding Title 10, Chapter 13, Sections 1 through 15 to the Livingston Municipal Code: Prohibition Against Underage Drinking and Social Host Liability.

  • City Council Guidance on Water Rates. After lengthy discussion, Mayor Samra directed staff to advertise the public hearing for this item in City utility bills in three languages.

  • City Council Guidance on Front Porches.
  • City Manager Warne reported that extra Prop 18 money was found to pave an additional alley between “D” and “E” and Second and Main Street.

  • City Council Guidance on Construction of Soccer Fields on City Wastewater Treatment Plant Property.
  • Kaye Greeley, Committee Chair (gave City Clerk written concerns) commented that the CAC gave a power point presentation and other information to the Council on the position of Code Enforcement Officer. She stated the CAC is requesting that the Council place the hiring of a Code Enforcement Officer on the next agenda.

  • Introduce and Waive the First Reading of an Ordinance of the City Council of the City of Livingston Amending Title 2, (Government Organization) Chapter 2 (Planning Commission) of the Livingston Municipal Code Relating to the Organization and Duties and Responsibilities of the Planning Commission.

·          DECEMBER 04, 2007  

  • Citizens’ Advisory Committee (CAC) Report.
  • Appointment of Parks and Recreation Commissioners.
  • Resolution Approving the Modifications to the City of Livingston Public Draft General Plan Update. A presentation of the summary of comments received during the 45-day review period. Discussion of specific land use and policy change requests made during the public review period.
  • Resolution Approving Site Plan/Design Review 2007-03, Foster Farms Deli Plant Break Room Expansion Project.
  • Resolution Approving Site Plan/Design Review 2007-05, for Two New Floor Plans in the Mansionettes at Davante Villas Subdivision.

Note, In April 1, 2008 a Settlement with Foster Farms was reported at the Council Meeting

·        Three water meters will be installed at Foster Farms on Aril 12, April 19 and April 26.

·        Secondly, Foster Farms will install their own backflow devices.

·        There will be a building permit fee. The City will have returned to it, 120 acres estimated at $200,000 an acre.

·        Terminated an option agreement that allowed Foster Farms to purchase this land at $1,000/acre.

·        Foster Farms will cleanout the wastewater ponds that are contaminated with sludge.

o       They are going to assume 100% of the cost.

·        City agrees to grandfather in buildings constructed without permits over the years and not inspect the facilities.
