LIVINGSTON CITY COUNCIL

MAY 12, 2010

A Special Meeting of the Livingston City Council was held in the City Council Chambers on May 12, 2010, with Mayor Varela presiding.

SPECIAL MEETING

CALL TO ORDER

Mayor Varela called the meeting to order at 5:15 p.m.

PLEDGE OF ALLEGIANCE

The pledge of allegiance to the flag was recited.

ROLL CALL

Mayor Daniel Varela, Sr.

Mayor Pro-Tem Frank Vierra

Council Member Rodrigo Espinoza (Absent)

Council Member Margarita Aguilar (Absent)

Council Member Martha Nateras

City Manager Richard Warne commented that Council Member Aguilar indicated she had a previous appointment at 4:00 p.m. He said that Council Member Aguilar told him that she would call him if she had any concerns about the agenda item.

City Manager Warne said the City Attorney, Jonathan Hobbs, was present by telephone on speaker phone. He has called in from his office and is part of the meeting.

Warren Urnberg, 1331 Eighth Street, asked why there were no public comments listed on the agenda. City Attorney Hobbs stated this is a special meeting and under state law, the meeting is limited to items on the agenda. He told Mr. Urnberg that he is welcome to comment on the agenda item this evening prior to the City Council voting.

CONSENT CALENDAR

1. Resolution Awarding Construction Contract to JJR Construction, Inc., San Mateo, California, Approving the Expenditure of Construction Funds for the Federal Safe Routes to Schools Sidewalk Installation Project – Project No. SRTSL-5256 (008) and Authorizing the City Manager to Execute a Construction Contract and Any Change Orders Thereto with JJR Construction, Inc.

The agenda item was presented by Mayor Varela.

Warren Urnberg asked what was the urgency of having a special meeting to consider the awarding of this contract.

City Manager Warne explained this is a safe-routes-to-school sidewalk construction project. The best time to construct sidewalks is when the children are not in school because of all of the heavy equipment and construction activities that will be taking place along the children’s’ school routes. This is not a new project for the City Council. This project has already been approved by the City Council and is in the City-Council approved budget document. Tonight’s bid award only carries out a decision that the City Council has already made and a construction project that they have already directed be built.

Warren Urnberg asked again why there was a need to have a special meeting and why the item could not wait until next Tuesday’s meeting. Mayor Varela said the City Council wants to expedite the construction project. Mr. Urnberg said that waiting five days shouldn’t make that much of a difference. Mayor Varela commented that in today’s environment where budgets are being cut and funding is being taken, it is important that this grant construction project move forward.

Motion: M/S Varela/Nateras to adopt Resolution No. 2010-22, awarding the construction contract to JJR Construction, Inc., San Mateo, California, Approving the Expenditure of Construction Funds for the Federal Safe Routes to Schools Sidewalk Installation Project – Project No. SRTSL-5256 (008) and Authorizing the City Manager to Execute a Construction Contract and Any Change Orders Thereto with JJR Construction, Inc.

The motion carried 3-2 by the following vote:

AYES: Council Members: Nateras, Varela, Vierra

NOES: Council Members: None

ABSENT: Council Members: Aguilar, Espinoza

The meeting was adjourned by consensus at 5:22 p.m.
