RESOLUTION FOR THE ACCEPTANCE OF THE FEDERAL SAFE ROUTES TO SCHOOLS CYCLE 2 SRTSL-5256 (008) PROJECT

RESOLUTION NO. 2011-

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON

FOR THE ACCEPTANCE OF THE FEDERAL SAFE ROUTES TO SCHOOLS CYCLE 2 SRTSL-5256 (008) PROJECT, AUTHORIZING THE CITY CLERK TO RECORD A NOTICE OF COMPLETION WITH MERCED COUNTY, AND AUTHORIZING THE ACTING CITY MANAGER TO RELEASE PERFORMANCE AND MATERIALS BONDS AND TO MAKE FINAL PAYMENT OF RENTENTION MONIES TO JJR CONSTRUCTION, INC.

WHEREAS, the City advertised the Federal Safe Routes to Schools Cycle 2 SRTSL-5256 (008) Project on March 25, March 31, April 1 and April 7, 2010; and

WHEREAS, the City received and the Deputy City Clerk publicly opened bids on May 4, 2010; and

WHEREAS, the City Council, at a regular meeting on May 12, 2010, awarded a contract to JJR Construction Inc, in the amount of $510,675.00 for the construction of the Sidewalk Improvements Project; and

WHEREAS, the total construction costs for the project in the amount of $617,3 85.85 are as follows:

Original Approved Contract Amount … . . . . . . . . . ..$510,675.00

Approved Contract Change Order No. 1… . . . . . . . . $ 82,574.50

Approved Contract Change Order No. 2… .. . . . .$ 17,796.00

Approved Contract Change Order No. 3… . . . …$ 6,340.35

WHEREAS, the Public Works Department has completed a final inspection of the project and recommends final acceptance; and

WHEREAS, upon approval of the final acceptance by the City Council, the City Clerk will record a Notice of Completion with Merced County and the Acting City Manager will release Performance and Materials Bonds and the retention monies due the Contractor after the normal 35-day appeal period.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston hereby:

1. Adopts a Resolution to accept the Federal Safe Routes to Schools Cycle 2 Project SRTSL-5256 (008).

2. Authorizes the City Clerk to record a Notice of Completion with Merced County.

3. Authorizes the Acting City Manager to release Performance and Materials Bonds to JJR Construction, Inc. after the normal 35-day appeal period, and make final payment of retention monies.
