AGENDA ITEM: Resolution for the Acceptance of the Phase 2 Water Line Improvements Project, Authorizing the City Clerk to Record a Notice of Completion with Merced County and Authorizing the City Manager to Release Performance and Material Bonds and to Make Final Payment of Retention Monies to California Trenchless, Inc.

RECOMMENDATION:

Adopt a Resolution for the Acceptance of the Phase 2 Water Line Improvements Project, authorizing the City Clerk to record a Notice of Completion with Merced County and authorizing the City Manager to release Performance and Material Bonds and to make final payment of retention monies to California Trenchless, Inc.

BACKGROUND:

The Phase 2 Water Line Improvements Project was advertised for bid on Februa1y 14, 2012. The Deputy City Clerk opened formal public bids on April 10, 2012. On May 1, 2012 the City Council awarded a contract to California Trenchless, Inc. of Dublin, CA in the amount of

$1,107,219.00 for the replacement of approximately 15,490 lineal feet of existing water line pipes within various roadway and alleyway locations throughout the City of Livingston. The work has now been completed in accordance with the project plans and specifications. The work was inspected by the Public Works Department; the project has been deemed to be substantially complete and it is recommended for acceptance by the City Council.

DISCUSSION:

The work involved the construction of potable water lines within various roadways and alleyways including installation of all valves, elbows, tees, reducers, installation of new water meters and boxes, connections to adjacent businesses and residences, demolition, grading, installation of concrete alleyway driveway entrances and restoration of roadways and alleyways to original conditions. A total of approximately I 0,550 lineal feet of new 6-inch PVC pipe and approximately 4,900 lineal feet of new 8-inch PVC pipe waterlines have been installed. The attached map shows the locations of the waterline installations completed as part of this project.

FISCAL IMPACT:

The waterline project was funded from the Water Fund. There was no impact to the General Fund.

Change orders in the amount of $l 09,086.68 were approved and completed. The total revised contract amount is $1,216,305.68.

RESOLUTION NO. 2013-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON FOR THE ACCEPTANCE OF THE PHASE 2 WATER LINE IMPROVEMENTS PROJECT, AUTHORIZING THE CITY CLERK TO RECORD A NOTICE OF COMPLETION WITH MERCED COUNTY AND AUTHORIZING THE CITY MANAGER TO RELEASE PERFORMANCE AND MATERIAL BONDS AND TO MAKE FINAL PAYMENT OF RETENTION MONIES TO CALIFORNIA TRENCHLESS, INC.

WHEREAS, the City advertised the Project on February 14, 2012; and

WHEREAS, the City received and the Deputy City Clerk publicly opened bids on April 10, 2012; and

WHEREAS, the City Council awarded a contract to California Trenchless, Inc. in the amount of

$1,107.219.00 for the construction of Phase 2 Water Line Improvements on May 1, 2012; and

WHEREAS, the Public Works Department has completed a final inspection of the Project and recommends final acceptance; and

WHEREAS, upon approval of the final acceptance of the Project by the City Council, the City Clerk will record a Notice of Completion with Merced County and the City Manager will release Performance and Material Bonds and the retention monies due the Contractor after the normal 35 day appeal period.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Livingston hereby:

1. Adopts a Resolution to accept the Phase 2 Water Line Improvements Project.

2. Authorizes the City Clerk to record a Notice of Completion with Merced County.

3. Authorizes the City Manager to release Performance and Material Bonds and to make final payment of retention monies to California Trenchless, Inc. after the normal 35-day appeal period.

NOTICE IS HEREBY GIVEN that the work of that certain project known as Phase 2 Water Line Improvements Project located within various streets throughout the City of Livingston, County of Merced, was completed on July 15, 2013, and was accepted by the City of Livingston on August 20, 2013. The Contractor for this project was California Trenchless, Inc., 11875 Dublin Boulevard, Suite C240, Dublin, California 94568. The property owner is the City of Livingston, 1416 “C” Street, Livingston, California 95334.
