AGENDA ITEM: Resolution Ratifying Acceptance of Department of Alcoholic Beverage Control (ABC) Grant through the Grant Assistant Program (GAP).

RECOMMENDATION:

The Police Department applied and was approved for a multi-agency grant in the amount of $47, 168 to enforce alcohol violations in the cities of Livingston, Atwater, and Gustine. The grant was from the Department of Alcoholic Beverage Control through the Grant Assistance Program. Staff recommends that the City Council adopt a resolution ratifying acceptance of the grant.

BACKGROUND/DISCUSSION:

The City Council accepted the grant at the June 4, 2013, meeting; however, staff inadvertently failed to request that a resolution be adopted which is needed to be submitted with the grant acceptance documents.

DISCUSSION:

This grant is for a one year period and will involve coordination between the three agencies for enforcement utilizing personnel from all three agencies within all three cities. This is effective to prevent recognition of police personnel enforcing violations in their own cities during undercover operations. The Livingston Police Department will manage and host the grant.

FISCAL IMPACT:

There is no impact to the General Fund.

RESOLUTION NO. 2013

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING, AUTHORIZING & RATIFYING THE SUBMITTAL OF THE GRANT YEAR

2013/2014 STATE OF CA ALCOHOLIC BEVERAGE CONTROL GRANT ASSISTANCE PROGRAM AND THE CITY OF LIVINGSTON

WHEREAS, the City of Livingston throngh its police department desires to undertake a certain project designated as the GAP grant which is funded through the Grant Assistance Program (GAP) administered by the Department of Alcoholic Beverage Control (ABC); and

WHEREAS, the City of Livingston Police Department will partner with the City of Atwater Police Department and the City of Gustine Police Department to work as the ABC GAP Task Force; and

WHEREAS, the City of Livingston will be administering said grant for all three cities.

NOW, THEREFORE, BE IT RESOLVED, that the City Manager and/or the Chief of Police of the City of Livingston is authorized to execute on behalf of the City Council of the City of Livingston the attached contract, including any extensions or amendments thereof and any subsequent contract with the State in relation hereto.

IT IS AGREED that any liability arising out of the performance of this contract, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and ABC disclaim responsibility for any such liability.

BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to supplant expenditures controlled by this body.

IT IS ALSO AGREED that the grant funds received hereunder shall not be comingled with any other funds.
