Staff recommends adoption of Resolution No. 2013-_, approving submittal ofa grant application to the California Department of Housing and Community Development (HCD) for HOME Investment Partnerships Program ("HOME") funds.
On May 1, 2013, the Department issued a 2013 Notice of Funding Availability announcing the availability of funds under the HOME program. On behalf of the City of Livingston, Self-Help Enterprises is preparing a grant application to HCD under the HOME program. The grant funds (totaling $700,000) will be used to provide low-income Livingston residents with first-time homebuyer down payment assistance and housing rehabilitation assistance. In the present housing market, it may be necessary for first-time homebuyers to perform health and safety repairs on homes prior to habitation. To assist these potential homebuyers, the application would therefore include First-Time Homebuyer (with or without Rehabilitation) and Owner-Occupied Rehabilitation.
If funded, the City would offer loans to first-time homebuyers and for homeowners in need of housing rehabilitation (correcting safety hazards and code violations). Payments would be deferred for the term of the loan. The grant application is due to HCD by July 8, 2013. HCD anticipates making award announcements by December 31, 2013.
HCD has waived the match requirement for this round of funding.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE HOME INVESTMENT PARTNERSHIPS PROGRAM; AND IF SELECTED, THE EXECUTION OF A STANDARD AGREEMENT, ANY AMENDMENTS THERETO, AND ANY RELATED DOCUMENTS NECESSARY TO PARTICIPATE IN THE HOME INVESTMENT PARTNERSHIPS PROGRAM
WHEREAS, the California Department of Housing and Community Development (the "Department") is authorized to allocate HOME Investment Partnerships Program ("HOME") funds made available from the U.S. Department of Housing and Urban Development ("HUD"). HOME funds are to be used for the purposes set forth in Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990, in federal implementing regulations set forth in Title 24 of the Code of Federal Regulations, part 92, and in Title 25 of the California Code of Regulations commencing with section 8200.
WHEREAS, on May l, 2013, the Department issued a 2013 Notice of Funding Availability announcing the availability of funds under the HOME program (the "NOFA").
WHEREAS, in response to the 2013 NOFA, the City of Livingston, a municipal corporation (the "Applicant"), wishes to apply to the Department for, and receive an allocation of, HOME funds.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston in response to the 2013 NOFA, shall submit an application to the Department to participate in the HOME program and for an allocation of funds not to exceed Seven Hundred Thousand Dollars ($700,000) for the following activities and/or programs:
First-Time Homebuyer with or without Rehabilitation Owner Occupied Rehabilitation to be located within the City limits of the City of Livingston.
BE IT FURTHER RESOLVED, if the application for funding is approved, then the Applicant hereby agrees to use the HOME funds for eligible activities in the manner presented in its application as approved by the Department in accordance with the statutes and regulations cited above. The Applicant may also execute a standard agreement, any amendments thereto, and any and all other documents or instruments necessary or required by the Department or HUD for participation in the HOME Program (collectively, the required documents).
BE IT FURTHER RESOLVED it is deemed in the best interest of the City of Livingston that the City Manager, Assistant City Manager/Finance Director, Senior Accountant, or his/her designee(s) be authorized to execute, in the name of the Applicant, the application, the consultant agreement, any and all NEPA documents, and the required documents.
