RECOMMENDATION:

Adopt Resolution No. 2013- ‘ for acceptance of the "CMAQ- Purchase Four (4) Replacement Heavy Duty Vehicles for Construction Activities", and authorizing the City Manager to release Performance and Material Bonds to N&S Tractor Company, Merced, CA; Holt of California, Turlock, CA; and Mission Valley Ford, San Jose, CA.

BACKGROUND:

In October 2011, the City was awarded $333,643.00 under the Federal Program for Congestion Mitigation and Air Quality (CMAQ) to purchase four (4) replacement heavy duty vehicles. City has an obligation of $43,357 towards the local match per the grant requirements. Total available funding for the project including the CMAQ grant funds and local match is $378,000.

The project generally consists of the purchase of two utility tractors, one dump truck and one aerial lift. The project was adve1tised for bid on October 22, 2011 and October 26, 2011 in the Modesto Bee, and on October 22,2011 and October 29,2011 in the Merced Sun-Star. Bids were opened by the Deputy City Clerk on December 13, 2011. On January 17, 2012, the City Council authorized approval of contracts with the respective bidders for supply of the vehicles.

DISCUSSION:

A total of three (3) bids were received. On January 17,2012, the City Council authorized approval of contracts with the respective bidders for supply of the vehicles as follows:

The total cost of the vehicles and the equipment is $311,434.27. No change orders were approved for the contractors. Hence the total cost of the vehicles and equipment is $311,434.87. Total project funding per the City Council authorization is $378,000.00.

All vehicles and equipment have been delivered to the City and inspected by the Public Works Department.

FISCAL IMPACT:

The costs for the project are paid from the Congestion Mitigation and Air Quality (CMAQ) grant funding in the amount of$275,712.75 and City’s local match funding in the amount of

$35,721.52 from the Local Transportation Fund. The total cost of the vehicles and the equipment

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON FOR THE ACCEPTANCE OF THE "CMAQ -PURCHASE FOUR (4) REPLACEMENT HEAVY DUTY VEHICLES FOR CONSTRUCTION ACTIVITIES," AND AUTHORIZING THE CITY MANAGER TO RELEASE PERFORMANCE AND MATERIAL BONDS TO N&S TRACTOR COMPANY, MERCED, CA; HOLT OF CALIFORNIA, TURLOCK, CA; AND MISSION VALLEY FORD, SAN JOSE, CA

WHEREAS, in October 2011, the City was awarded $333,643.00 under the Federal Program for Congestion Mitigation and Air Quality (CMAQ) to purchase four (4) replacement heavy duty vehicles; and

WHEREAS, the project generally consists of the purchase of two utility tractors, one dump truck and one aerial lift; and

WHEREAS, the project was advertised for bid on October 22, 2011 and October 26, 2011 in the Modesto Bee, and on October 22, 2011 and October 29, 2011 in the Merced Sun-Star. Bids were opened by the Deputy City Clerk on December 13, 20 II;and

WHEREAS, the City Council, at a regular meeting on January 17,2012, authorized approval of contracts with the respective bidders for supply of the vehicles; and

WHEREAS, the total costs for the project are paid from the Congestion Mitigation and Air Quality (CMAQ) grant funding in the amount of$275,712.75 and City’s local match funding in the amount of $35,721.52 from the Local Transportation Fund. WHEREAS, the total project funding per City Council authorization is $378,000.00. WHEREAS, all vehicles and equipment have been delivered to the City and inspected by

the Public Works Department.

WHEREAS, upon approval of the final acceptance by the City Council, the City Manager will release Performance and Material Bonds and the retention monies due the Contractors after the normal 35-day appeal period.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Livingston hereby:

I. Adopts a Resolution to accept the "CMAQ –Purchase Four (4) Replacement Heavy Duty Vehicles for Construction Activities."

2. Authorizes the City Manager to release Performance and Material Bonds to N&S Tractor Company, Merced, CA; Holt of California, Turlock, CA; and Mission Valley Ford, San Jose, CA after the normal 35-day appeal period.
