RECOMMENDATION:

Adopt Resolution No. 2013-_, amending the Professional Engineering Services Contract with AECOM, Fresno, CA, for additional design and construction support services for the 1,2,3 Trichloropropane (TCP) Treatment at the City Water Supply Well No. 8, and authorizing the City Manager to execute the amendment.

BACKGROUND:

On December 16, 2011, the City Council approved a Consultant Agreement with AECOM of Fresno, CA for design services to prepare contract documents and provide construction bid support for the construction of a Granular Activated Carbon wellhead treatment facility at Well No. 8. AECOM has completed and submitted 90% improvement plans and specifications and is working on the final documents. AECOM presented the information regarding the project to the Stakeholders Committee during the design period.

DISCUSSION:

In March 2013, Staff requested that AECOM prepare a scope of work and a fee proposal for all of the work necessary to upgrade the Programmable Logic Controllers (PLC’s) and Supervisory Control and Data Acquisition (SCADA) system controls for the Well 8 treatment and pump processes using nonproprietary open source components and instruments. AECOM’s proposal for the additional scope of work is attached.

Amendment I in the amount of $24,489 for the Rapid Small Scale Column Testing (RSSCT) and Amendment 2 in the amount of $9,947 for addition of connection to the sewer system and pump controls were previously approved. The current proposed amendment in the amount of $47,944 will bring the total contract amount for AECOM to $193,533.

Staff recommends approval of this amendment to the Consultant Services Agreement.

FISCAL IMPACT:

The proposed fee for the additional scope of work included with this amendment is $47,944. With the addition of this amendment, the total fee for the design and construction support services for completion of the design for 1,2,3 Trichloropropane (TCP) Treatment at the City Water Supply Well No. 8 is $193,533 including hourly wage costs, and non-labor costs. The services under the contract will be paid for out of the TCP Settlement Fund. There will be no impact to the General Fund Operations.

RESOLUTION OF THE CITY COUNCIL OF CITY OF LIVINGSTON APPROVING AMENDMENT NO. 3 TO THE PROFESSIONAL ENGINEERING SERVICES CONTRACT BETWEENTHE CITY OF LIVINGSTON AND AECOM OF FRESNO, CA FOR ADDITIONAL SERVICES FOR THE 1,2,3 TRICHLOROPROPANE (TCP) TREATMENT FACILITY AT THE CITY WATER SUPPLY WELL NO. 8 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT

WHEREAS, the City of Livingston executed a Professional Engineering Services with AECOM of Fresno, CA to prepare plans and bid documents for the 1,2,3- Trichloropropane TCP Treatment Facility; and

WHEREAS, AECOM submitted a fee proposal and modified scope of work for design and additional construction bidding support for the instrumentation and process controls for the 1,2,3 TCP Treatment Facility at the City Water Supply Well No. 8; and

WHEREAS, the proposed fee for Amendment No. 3 to the Professional Services Consultant Contract is $47,944, and the total cost of the original Professional Services Contract plus Amendments 1, 2, and 3 will be $193,553 including hourly wage costs, and non-labor costs; and

WHEREAS, the services under the contract will be paid for from the 1,2,3-TCP Settlement fund.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston hereby adopts a Resolution to approve Amendment No. 3 to the existing Professional Engineering Services Contract with AECOM of Fresno, CA for 1,2,3 Trichloropropane (TCP) Treatment at the City Water Supply Well No.8, and Authorizing the City Manager to execute the amendment.
