RECOMMENDATION:

Adopt Resolution No. 2013-_, authorizing the purchase of land needed for the installation of water treatment facilities at the City Water Supply Well No. 8, approval of the Appraisal Report prepared by The Thomas Wilkins Company, and authorizing the City Manager to execute the agreement with Foster Farms for the purchase of the land.

AUTHORITY: Title 9, Chapter 5, Section 8 of the City of Livingston Municipal Code deals with water service regulations and empowers the Public Works Department to acquire equipment and incidentals to maintain the City water system.

BACKGROUND:

The City of Livingston contracted with AECOM Engineers for the preparation of design and bid documents for the facilities to treat 1,2,3 Trichloropropane (TCP) at the City Water Supply Well No. 8 located on Main Street (previously Livingston/Cressey Road). AECOM will be submitting final bid documents to the City to proceed with bidding the project in June 2013. Approximately 18,267 sq. ft of land is needed to locate the treatment facilities at the existing Well No. 8. The adjacent property (APN 024-020-023 and 029) is owned by Foster Farms.

An Appraisal Report was prepared by The Thomas Wilkins Company (dated February 21, 2012) under contract with the City. Foster Farms was provided a copy of the report and has agreed to the sale price recommended in the Appraisal Report of $42,140.00.

DISCUSSION:

As the City’s consultant, AECOM is finalizing the design and bid documents for the treatment facilities to treat 1,2,3 Trichloropropane (TCP) at the City Water Supply Well No. 8. The City will need to acquire the additional land needed for the facilities. AECOM will prepare the Grant Deed documents and related easement documents for approval by the City and Foster Farms. Cost of preparation of the deed documents is $2,150.00. The cost proposal submitted by R.B. Welty & Associates, Inc. working as subconsultant to AECOM is attached for reference.

Exhibit 1 shows the location of the project and property to be acquired.

FISCAL IMPACT:

The purchase price of $42,140.00 for the land to be acquired by the City from Foster Farms for the facilities to treat 1,2,3 Trichloropropane (TCP) at the City Water Supply Well No. 8 and the cost of preparation of the deed documents for the acquisition in the amount of $2,150.00 will be funded from the TCP Settlement Fund. There will be no impact to the General Fund Operations.

RESOLUTION OF THE CITY COUNCIL OF CITY OF LIVINGSTON AUTHORIZING THE PURCHASE OF LAND NEEDED FOR THE INSTALLATION OF WATER TREATMENT FACILITIES AT THE CITY WATER SUPPLY WELL NO.8, APPROVING THE APPRAISAL REPORT PREPARED BY THE THOMAS WILKINS COMPANY AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WITH FOSTER FARMS FOR THE PURCHASE OF THE LAND

WHEREAS, the City of Livingston retained AECOM of Fresno, CA to prepare design and bid documents for the facilities to treat 1,2,3 Trichloropropane (TCP) at the City Water Supply Well No. 8 located on Main Street (previously Livingston/Cressey Road); and

WHEREAS, approximately 18,267 sq. ft of land is needed to locate the treatment facilities at the existing Well No. 8; and

WHEREAS, an Appraisal Report was prepared by The Thomas Wilkins Company (dated February 21, 2012) under contract with the City; and

WHEREAS, Foster Farms was provided a copy of the report and has agreed to the sale price recommended in the Appraisal Report of $42,140.00.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston hereby adopts a Resolution authorizing the purchase of land needed for the installation of water treatment facilities at the City Water Supply Well No. 8, approving the Appraisal Report prepared by The Thomas Wilkins Company and authorizing the City Manager to execute the agreement with Foster Farms for the purchase of the land.
