RECOMMENDATION:

Adopt Resolution No. 2013-_, a Resolution to award a construction contract to Conco West, Inc. of Manteca, CA; approving the expenditure of construction funds for Well No. 8 Wellhead Treatment System and authorizing the City Manager to execute a construction contract and any Change Orders thereto with Conco West, Inc.

BACKGROUND:

In July 2004, the State of California Department of Health Services (CDHS) sent a letter to the City of Livingston notifying the City that the levels of 1,2,3-Trichloropropane (1,2,3-TCP) exceeded public health goals and required action by the City. In response to that letter, the City aggressively pursued potential solutions to effectively address the 1,2,3-TCP contamination issue.

The City solicited proposals from qualified professional design firms to evaluate best available treatment technologies for removing TCP from the source water and to prepare the design documents for a treatment system at Well No. 8. The City awarded a professional services contract to AECOM, Inc. of Fresno, CA for the design of Wellhead Treatment Facilities at Well No. 8 in December 2011. AECOM completed its design for the treatment system and prepared the bid documents.

In August 2013, the City solicited bids from qualified construction firms for the wellhead treatment system. The work to be performed under this contract shall consist of furnishing all of the labor, supervision, materials, and equipment necessary for the construction of a new wellhead treatment system for the removal of TCP at Well No. 8. The wellhead treatment system shall include four pressure vessels for granular activated carbon media; a bolted steel backwash tank and recirculation pump; a flush-to-waste storm drain connection; a sanitary sewer connection; piping, valves, and appurtenances, including a manifold for a future connection for Well 14; instrumentation and controls; and 80,000 pounds of virgin coconut based granular activated carbon.

The project was advertised for bid on August 3, 2013 and August 10, 2013 in the Modesto Bee and Merced Sun-Star. The Deputy City Clerk opened bids on September 13, 2013.

DISCUSSION:

The Engineer’s Opinion of Probable Construction cost for the project based on the 100% Plans and Specifications was $1,888,000.00.

A total of one (1) bid was opened and read aloud by the Deputy City Clerk at 2:00 p.m. on September 13, 2013. Conco West, Inc. of Manteca, CA. submitted a bid proposal to perform all of the work detailed in the contract documents for a total of $1,874,600.00.

Based on the review of the bid and on an interview of perspective bidders by the project engineer, it is staff s opinion that it is in the City’s best interest to award the contract to Conco West, Inc.

FISCAL IMPACT:

The construction costs for the project including construction, construction inspections, management and contingencies in the amount of $2,062,000 will be funded from the TCP Settlement Fund. There will be no impact to the General Fund.

WHEREAS, the apparent low bid was submitted by CONCO WEST, INC. in the amount of $1,874,600; and

WHEREAS, City staff has reviewed the submitted bid and recommends the award of a construction contract to CONCO WEST, INC.; and

WHEREAS, the construction costs for the project including construction, construction inspections, management and contingencies in the amount of $2,062,000 will be funded from the TCP Settlement Fund.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby:

I. Adopts a Resolution awarding a construction contract to CONCO WEST, INC. of Manteca, CA for the Well No. 8 Wellhead Treatment System.

2. Approves the expenditure of construction funds.

3. Authorizes the City Manager to execute a construction contract with CONCO WEST, INC. and any Change Orders thereto.
