AGENDA ITEM: Resolution Approving a Land Lease Agreement Between the City of Livingston and Gerald Martin for Approximately 40 Acres of Land at 15036 Vinewood Avenue Known as APN Numbers 047-140-006 and 047-140-0017.

RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 2013-_ approving a laud lease agreement between the City of Livingston and Gerald Mmtin for approximately 40 acres of land at 15036 Vinewood Avenue known as APN Numbers 047-140-006 and 047-140-0017.

BACKGROUND AND DISCUSSION:

In March of 2006, the City purchased 54.6 acres of land at 15036 Vinewood Avenue outside of the City limits from Lillian Horta for $1,400,000.00 to be used for future expansion of the Domestic Wastewater Treatment Plant. The land is currently unused and the City is incurring annual costs for weed abatement and maintenance. The City has received a request from a neighboring property owner, Gerald Martin who would like to lease 40 acres of the land to grow and maintain a pasture and keep cattle on the land. Mr. Martin has agreed to maintain all fencing, install gates, maintain and pay for operation of the water pumps and keep the property in good condition. The property lease agreement would be for a term of five (5) years commencing October 1, 2013 and terminating on October I , 2018. The lease amount would be $500.00 for five (5) years.

FISCAL IMPACT:

Potential annual rental income to the City of $6,000.00. Potential savings of several thousand dollars in labor and materials costs to remove weeds, perform tractor work and maintain fencing.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING A LAND LEASE AGREEMENT BETWEEN THE CITY OF LIVINGSTON AND GERALD MARTIN FOR APPROXIMATELY 40 ACRES OF LAND AT 15036 VINEWOOD AVENUE KNOWN AS APN NUMBERS 047-140-006 AND 047-140-0017

WHEREAS, in March of 2006, the City of Livingston purchased 54.6 acres of land outside of the City limits at 15036 Vinewood Avenue (APN Numbers 047-140-006 and 140-140-0017 from Lillian Horta for $1,400,000.00; and

WHEREAS, the land was purchased for future expansion of the City’s Domestic Wastewater Treatment Plant; and

WHEREAS, the land is currently unused and the City is incurring annual costs for weed abatement and maintenance of the property; and

WHEREAS, the City has received a request from Gerald Martin to lease 40 acres of the property to grow and maintain a pasture and keep cattle on the land; and

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston hereby approves a Land Lease Agreement with Gerald Martin for lease of approximately 40 acres of land at 15036 Vinewood Avenue pursuant to the above noted lease term and lease amount.
