RECOMMENDATION:

Adopt Resolution No. 2013-_, a Resolution awarding a construction contract to FBD Vanguard Construction, Inc., Livermore, CA, approving the expenditure of construction funds for the CMAQ Pedestrian Improvements Sidewalk Installation Project – Project No. CML-5256 (012) and authorizing the City Manager to execute a construction contract and any Change Orders thereto with FBD Vanguard Construction, Inc.

BACKGROUND:

The City of Livingston was awarded grant funds in the amount of $597,786 under the Federal Program for Congestion Mitigation and Air Quality (CMAQ) to construct pedestrian improvements in Livingston. The City has an obligation of $77,449 towards the local match per the grant requirements. Total available fund ing for the project including the CMAQ grant funds and local match is $675,235.

The project generally consists of installation of new curb and gutter and sidewalk, wheelchair ramps, driveways and alleyway entrances, storm drainage improvements, landscaping and other associated improvements on several streets including Crowell Street (Stefani Avenue to White Avenue), White Avenue (Crowell Street to Swan Street), Swan Street (Stefani Avenue to North Main Street), Simpson Avenue (Crowell Street to Swan Street), Swan Street (Simpson Avenue to Franci Street), Franci Street (Davis Street to Crowell Street), Crowell Street (Simpson Avenue to Franci Street), Stefani Avenue (Crowell Street to Davis Street) [Additive Bid Alternate “A”], and White Avenue — Storm Drainage Facilities [Additive Bid Alternate “B”]

The project was originally advertised in July 2013 and bids opened on July 29, 2013. On August 20, 2013, the City Council rejected the bids that were received on July 29, 2013, and authorized staff to rebid the project.

The project was re-advertised for bid on August 30, 2013 and September 6, 2013 in the Modesto Bee and the Merced Sun-Star.

DISCUSSION:

A total of four (4) bids were opened and read aloud by the Deputy City Clerk at 2:00 p.m. on September 12, 201 3, this being the advertised bid opening date and time. The apparent low bid was submitted by FBD Vanguard Construction, Inc. in the amount of $503, 172.25. The attached Bid Summary shows the bid details.

City staff has determined that the bids fall within the approved funding sources provided for this project. The award is based on the Base Bid items only; Additive Bid items of work are not included in the award.

FISCAL IMPACT:

The project construction costs for the project including construction costs, construction testing, inspections, grant management, contingency, and construction engineering is $613,500. Costs of the project will be funded with grant funds in the amount of $557,948 under the Federal Program for Congestion Mitigation and Air Quality (CMAQ) grant and $72,287 local match. The local match source of funds will be from transportation and gas tax funds. There will be no impact to the General Fund.

WHEREAS, in November 2011, the City was awarded under the Congestion Management and Air Quality Improvement Program (CMAQ) the amount of $675,235; and

WHEREAS, the Project was advertised for bid on August 30, 2013 and September 6, 2013 in the Modesto Bee and in the Merced Sun-Star. Bids were opened by the Deputy City Clerk on September 12, 2013; and

WHEREAS, a total of four (4) bids were opened and read aloud by the Deputy City Clerk at 2:00 p.m. on September 12, 2013, this being the advertised bid opening date and time; and

WHEREAS, City staff has reviewed all submitted bids and recommends the award of a construction contract to FBD VANGUARD CONSTRUCTION, INC.; and

WHEREAS, the project construction costs for the project including construction and construction engineering in the amount of $613,500 will be funded from the Congestion Management and Air Quality Improvement Program (CMAQ) grant funds and Local Match funds.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby:

1. Adopts a Resolution awarding a construction contract to FBD VANGUARD CONSTRUCTION, INC., LIVERMORE, CA, approving the expenditure of construction funds for the CMAQ PEDESTRIAN IMPROVEMENTS SIDEWALK INSTALLATION PROJECT – PROJECT NO. CML-5256(012)).

2. Approves the expenditure of construction funds.

3. Authorizes the City Manager to execute a construction contract with FBD VANGUARD CONSTRUCTION, INC. and any Change Orders thereto.
