RECOMMENDATION:

Adopt Resolution No. 2014- , authorizing the City Manager to execute a one (1) year concessions agreement with Paul Maurer Shows to provide carnival rides, food and games booths at the Sweet Potato Festival scheduled for September 19th, 20th, and 21st, 2014.

BACKGROUND:

The City of Livingston partnered with Paul Maurer Shows (PMS) to deliver a great community event last year. The Sweet Potato Festival creates a family environment where children are the focus.

Management would like to bring back this festivity in an attempt to provide some level of community entertainment. PMS has been performing at community carnivals for many years throughout California and successfully participated in the 2012 and 2013 4th of July carnivals as well as the 2013 Sweet Potato Festival.

This agreement covers concessions to include carnival rides, food and game booths, and a set City commission of 25% for on-site ticket sales to 30% on pre-sale tickets plus $150 per operated booth by PMS during the carnival. PMS agrees to provide proper liability insurance, licenses and permits to operate the carnival.

This event is scheduled for September 19th through September 21st at the Livingston Sports Complex Park area(s).

DISCUSSION:

Approval of a one (1) year concessions agreement with PMS to provide carnival rides, food and game booths at the City’s 2014 Sweet Potato Festival.

FISCAL IMPACT:

Revenues generated for the City through an agreed 25% (on-site) and 30% (pre-sale) of ticket sales and $150 per operated booth during the carnival will assist in covering event related expenditures.

RESOLUTION NO. 2014-

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING AND AUTHORIZING THE CITY MANAGER TO

EXECUTE A ONE (1) YEAR CONCESSIONS AGREEMENT BETWEEN THE CITY OF LIVINGSTON AND PAUL MAURER SHOWS ("PMS")

WHEREAS, the City of Livingston plans to participate in the community’s 2014 Sweet Potato Festival set for the month of September 2014; and

WHEREAS, the site for the festival will be at the Livingston Sports Complex Park; and

WHEREAS, the one (1) year agreement is for concessions to include carnival rides, food and game booths; and

WHEREAS, PMS has agreed that the City collect 25% (on-site) and 30% (pre-sale) of ticket sales plus $150 per PMS operated booth; and

WHEREAS, PMS has agreed to provide proper liability insurance coverage, licenses and permits to operate the carnival; and

WHEREAS, the City wishes to approve a one (1) year concessions agreement with PMS.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Livingston hereby approves a one (1) year concessions agreement with PMS to provide carnival rides, food and game booths during the Sweet Potato Festival at the agreed upon terms and conditions of the concessions agreement between the City and PMS incorporated herein by reference and authorizes the City Manager to execute an agreement in a form approved by legal counsel.
