RECOMMENDATION:

Adopt a Resolution amending conditions of approval for Site Plan/Design Review 2013-04 for the Proposed Motel 6 Project, a 75-room, 3-story Motel on a 2.43-acre Parcel Located at 110 N. Del Rio Avenue.

BACKGROUND:

The proposed project was approved with conditions by the City Council on February 18, 2014. Since that time, the applicant has asked that condition #7 be amended, changing the year referenced for building and fire code requirements that would apply to this project from 2013 to 2010, with the understanding that when they initiated the project and paid for the above entitlement, the building and fire codes in place at that time would apply. Staff has agreed with this understanding. All conditions of approval for this project, with this exception, remain in effect for this project.

ENVIRONMENTAL STATUS:

The Project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA Guidelines Section 15332 In-Fill Development Projects).

GENERAL PLAN CONSISTENCY:

The proposed amendment is not a substantial change and will not affect the determination that the project is consistent with the 1999 General Plan.

FISCAL IMPACT:

Permit fees and tax dollars.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON AMENDING CONDITIONS OF APPROVAL FOR SITE PLAN/DESIGN REVIEW 2013-04

FOR A MOTEL 6 AND FUTURE RESTAURANT TO BE LOCATED AT 100 AND 110 N. DEL RIO AVENUE, LIVINGSTON, CA

WHEREAS, Livingston Hospitality, LLC, has submitted Site Plan/Design Review 2013-04 for a Motel 6 and future restaurant to be located at 100 and 110 N. Del Rio Avenue (Assessor Parcel Number 22-10-16 ); and

WHEREAS, Applicant for the project has requested that an amendment be made to the conditions of approval that City Council approved by a vote of 3-0-2 on the meeting of February 18, 2014; and

WHEREAS, Staff has concurred with the proposed amendment to the conditions of approval number 7; and

WHEREAS, this project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA Guidelines Section 15332 In-Fill Development Projects).

BE IT FURTHER RESOLVED that the City Council hereby adopts Resolution 2014-_, Amending Conditions of Approval for Site Plan/Design Review 2013-04 for Motel 6, attached as Exhibit "A":
