RECOMMENDATION:

Adopt Resolution No. 2014-_, approving a Successor Memorandum of Understanding between City and the Livingston Police Supervisors’ OE3 Unit for the period of July 1, 2013 through December 31, 2014.

BACKGROUND:

The City of Livingston through the City Manager and the Supervisors’ OE3 Unit have been through negotiations for nearly a year. The Supervisory unit exercised their right to the fact finding procedure in late 2013. The City of Livingston and Supervisory unit both agreed to have Christopher D. Burdick serve as the fact :finder(neutral person) to satisfy the legal procedures. The fact finding process was lengthy, time consuming and unbudgeted cost was incurred.

The City of Livingston and Supervisory OE3 have reached a tentative agreement to a Successor Memorandum of Understanding, covering the period July 1, 2013 through December 31, 2014, which incorporates recommendations by the fact finder, Christopher D. Burdick. Recommendations consist of

(1) MOU term from July 1, 2013 through December 31, 2014 (2) Wage reduction of seven (7%) percent effective March 2, 2014 through December 31, 2014, salaries/wages shall revert to the rate effective on February 28, 2014 (3) Health care contribution of $50 per month effective March 2, 2014 plus an additional $50 monthly contribution effective July 1, 2014 and (4) Vacation cash-outs, a forty (40) hour cap effective through December 31, 2014, at which time it shall revert to the caps applicable on February 28, 2014.

The Successor Memorandum of Understanding was not :finalized at time this staff report was prepared and therefore the MOU will be available at the Council meeting prior to voting.

DISCUSSION:

The terms of the current Memorandum of Understanding shall be extended to cover the period July 1, 2013 through December 31, 2014, with the changes mentioned above, unless modified, changed, or otherwise altered by force of law or by mutual agreement between the parties of this agreement. The final modifications to MOU will be provided at Council meeting.

FISCAL IMPACT:

Personnel cost savings.

RESOLUTION NO. 2014-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING A SUCCESSOR MEMORANDUM

OF UNDERSTANDING BETWEEN THE CITY OF LIVINGSTON AND

THE LIVINGSTON POLICE SUPERVISORS’ OE3 UNIT FOR THE PERIOD OF JULY 1, 2013 THROUGH DECEMBER 31, 2014

WHEREAS, the City of Livingston, through its City Manager, has negotiated new terms after reaching a tentative agreement through the fact finding process; and

WHEREAS, agreement will alter or change the existing Memorandum of Understanding, as it applies to the Livingston Police Supervisors’ Unit; and

WHEREAS, the terms of the extended Memorandum of Understanding between the City of Livingston and the Livingston Police Supervisors’ Unit are effective July 1, 2013 through December 31, 2014; and

WHEREAS, the City Council now desires to formally approve those changes in the Memorandum of Understanding as has been negotiated and approved by the parties.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Livingston that it hereby:

1. Approves a Successor Memorandum of Understanding between the City of Livingston and the Livingston Supervisors’ Unit, in a form approved by the City Attorney, and substantially in the form attached hereto as Exhibit A, for the period of July 1, 2013 through December 31, 2014.

2. Wages- a seven percent (7%) wage/base salary reduction effective March 2, 2014 and ending December 31, 2014, on which date the salaries shall revert to the rate effective on February 28, 2014; and

3. Health Care-Employee member contribution of $50 per month effective March 2, 2014 and an additional $50 per month effective July 1, 2014; and

4. Vacation Cash Out- a forty (40) hour cap effective through December 31, 2014, at which time it shall revert to the caps applicable on February 28, 2014.
