RECOMMENDATION:

Adopt Resolution No. 2014-_, authorizing the City Manager or his designee to execute right-of-way certifications.

BACKGROUND:

Certain regulations of the California Department of Transportation (Caltrans) require Right-of-Way Certifications which assure that a local public agency has or will have possession of required right-of­ way.

A Right-of-Way Certification is required for certain types of projects, including, but not limited to, all local streets and road projects that will be advertised by the State or that only have State funding, as well as projects that are Federally funded in either the right-of-way or construction phase.

DISCUSSION:

Caltrans regulations require the submission of a resolution by the governing body of the local agency granting the City Manager or his designee authority to execute the Right-of-Way certification.

FISCAL IMPACT:

None to the City.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON AUTHORIZING THE CITY MANAGER TO EXECUTE THE RIGHT-OF-WAY CERTIFICATION FOR CMAQ SIDEWALK INFILL ON STEFANI AVENUE, WIDTE AVENUE, CROWELL STREET, AND SIMPSON AVENUE IN THE CITY OF LIVINGSTON, FEDERAL PROJECT NO. CML-5256(016)

WHEREAS, the City of Livingston has received the Right-of-Way Certification for the CMAQ­ Sidewalk Infill on Stefani Avenue, White Avenue, Crowell Street, and Simpson Avenue, Federal Project No. CML-5256(016); and

WHEREAS, the City Council does hereby approve the Right-of-Way Certification of said project; and

WHEREAS, the City Council appoints the City Manager as the designated City Representative to execute the Right-of-Way Certification for CMAQ – Sidewalk Infill on Stefani Avenue, White Avenue, Crowell Street, and Simpson Avenue, Federal Project No. CML-5256(016).

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Livingston hereby adopts a Resolution authorizing the City Manager to execute the Right-of-Way Certification.

Passed and adopted this 13th day of November, 2014, by the following vote:
