PROPOSED ACTION: Adopt Resolution 2015-_ , recommending approval by the City Council of new elevations and floor plans submitted for the Sun Valley Estates subdivision by new owner (Gold Circle, LLC) of remaining vacant parcels. Gold Circle, LLC has submitted a Site Plan/Design Review application to construct ten (10) single-family residential units (including 2 model homes), ranging in size from 2,034 sq. ft. to 3,102 sq. ft. in the existing subdivision of Sun Valley Estates, located southwest of the intersection of Peach Avenue and Main Street on property zoned Low­ Density Residential (R-1), APN numbers 047-581-003 and -004; 047-582-021 and -022; and 047-586-002 through -007.

Street Access:  Peach Avenue, Main Street, and extensions through the subdivision (Sun Valley Avenue, Newcastle Drive).

BACKGROUND:

Tentative Subdivision Map No. 93-01 and a Mitigated Negative Declaration for Somerset were approved in April 1993 by the Livingston City Council for 134 lots on approximately 29.5 acres. The Development Agreement 2004-03 for Somerset (Sun Valley Estates) was approved in July 1993, and the Design review of the original housing product was approved on September 13, 2005. Twenty-three houses were constructed in and around 2006. As the economic downtown occurred, however, construction ceased and the remaining lots became available for purchase.

Gold Circle, LLC purchased the remaining lots in 2014, and approached the City about building eight ‘spec’ houses and two model homes on an initial ten (10) lots, with expectations to eventually complete the subdivision. The City Engineer has given them a will­ serve letter for water quantity for thirty homes to be built at this time. The applicant has voluntarily participated in community outreach and has had a positive response to the project from existing neighbors in the subdivision.

In addition, they have agreed to build a wall around the Well # 17 in the subdivision (Attachment B). Finally, their intention is to construct a monument sign at Peach Avenue to identify the subdivision at a future date, and this was encouraged by City staff. There are 101 vacant lots left in the subdivision.

PROJECT DESCRIPTION:

These new plans range in size from 2,034 sq. ft. to 3,102 sq. ft., are one and two story plans and resemble previously approved plans in the existing neighborhood. Architectural details, such as stone, shutters, vents, and pop-outs provided in the elevations are, as always, standard home features.

DESIGN REVIEW:

The approved design packages for the project includes the following four design plans with three style options for each plan. Plans One and Two are single-story models, while Three and Four are two-story models.

Staff has reviewed the floor plans and elevations for the project. The project successfully addresses many of the architectural recommendations in the Design Guide. The developer will be using the colors and materials compatible with those previously approved for this project. A standard Condition of Approval requiring enhanced side elevations for comer lot homes has been added to the Resolution. The developer is sensitive to the fact that there are existing houses in the subdivision, and has not only made the effort to choose colors and materials that will be compatible with the existing older homes, but has engaged in community outreach with the existing neighborhood, as previously mentioned.

RECOMMENDATION:

Staff is recommending that the Planning Commission adopt Resolution 2015-_, recommending that the City Council approve the Design Review for the new plans for Sun Valley Estates subdivision with the Conditions of approval, below:

1. Gold Circle, LLC shall provide enhanced elevations for the street sides of comer houses to comply with Resolution 2005-107 (Attachment A).

2. That Gold Circle, LLC comply with the conditions regarding the construction of the perimeter wall around Well #17, which serves the project and is located on Lot 54 at the northeast comer of Sun Valley Avenue and Spring Brook Drive (Attachment B).

RESOLUTION 2015-

RESOLUTION OF THE PLANNING COMMISSION

OF THE CITY OF LIVINGSTON RECOMMENDING TO THE CITY COUNCIL APPROVAL OF NEW FLOOR PLANS AND ELEVATIONS FOR

SUN VALLEY ESTATES (FORMERLY SOMERSET SUBDIVISION)

WHEREAS, a Vesting Tentative Map 93-01 for Somerset/Sun Valley Estates, located southwest of the intersection of Peach Avenue and Main Street in the City of Livingston, was approved in April 1993 and the Final Map for this subdivision was approved on August 16, 2005, by the Livingston City Council; and

WHEREAS, 23 lots out of a total of 134 lots were completed in 2006 before the economic downturn; and

WHEREAS, Gold Circle LLC has now acquired the remaining lots to be developed and proposes to construct ten (10) single-family residences on ten lots located on Park View Drive, Wells Avenue and Sun Valley Avenues; and

WHEREAS, Site Plan/Design Review 2005-23 for the approval of architectural, landscape and color scheme design for the Somerset (Sun Valley Estates) subdivision was approved by the Planning Commission on September 13, 2005, and Site Plan/Design Review 2005-107, adding modification to two-story floor plans and homes with more than one exposed side was approved by City Council on October 4, 2005; and

WHEREAS, Gold Circle has submitted four (4) new floor plans for approval, two single story plans and two two-story plans; and

WHEREAS, Staff has reviewed the Plans with reference to the adopted Livingston Design Guide.

NOW, THEREFORE, BE IT RESOLVED, that the Livingston Planning Commission hereby adopts Resolution 2015-_, recommending City Council approval of four new floor plans and elevations within the Sun Valley Estate subdivision subject the following conditions:

1. Gold Circle, LLC shall provide enhanced elevations for the street sides of comer houses to comply with Resolution 2005-107 (Attachment A).

2. That Gold Circle, LLC comply with the conditions regarding the construction of the perimeter wall around Well #17, which serves the project and is located on Lot 54 at the northeast comer of Sun Valley Avenue and Spring Brook Drive (Attachment B).

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING THE ARCHITECTURAL AND COLOR SCHEME DESIGN FOR SOMERSET SUBDIVSION

WHEREAS, Cambria Ventures (former owner) submitted a Vesting Tentative Subdivision Map application for the construction of 134 single-family homes in Somerset (formerly Sunvalley Estates) to be built southwest of the intersection of Peach Avenue and Lincoln Blvd., bounded on the west and south by the City Limit lines; and

WHEREAS, the Vesting Tentative Map for Somerset (formerly Sunvalley Estates) was approved by the City Council in April 1993 and the Final Map was approved on August 16, 2005; and

WHEREAS, the project is subject to design review and approval by the Planning Commission and City Council as a condition of project approval; and

WHEREAS, on September 13, 2005, the Planning Commission adopted Resolution 2005-107 recommending approval of the architectural and color scheme design for Somerset residential subdivision, provided the following modification is made:

1. On all two-story floor plans and homes with more than one exposed side (such as homes on comer lots or that back up to a street), YCH Communities shall provide additional visual interest enhancements to the side and rear facades, such as second-story setbacks, balconies, eave overhangs, architectural pop-outs, shutters, ironwork or dormers.

NOW, THEREFORE, BE IT RESOLVED, that the City Council adopts Resolution 2005-107 approving the design review for Somerset Subdivision, in ·accordance with the recommendations made by the Planning Commission.

Passed and adopted this 4th day of October 2005, by the following vote:

This memorandum is a follow up to our meeting in your office on January 14th also attended by Mr. Coy Stark (Developer), and Mr. Jose Ramirez, then City Manager. During the meeting, it was reiterated to Mr. Stark that the City of Livingston will require the Developer to pay for construction of the perimeter wall and gate at the Well No. 17 site. It was also indicated to Mr. Stark that the wall and gate will be similar to those on Well No. 13. The wall will be split face CMU, approximately 8-feet tall. A Google Map Street View image of the wall at Well 13 was shown to Mr. Stark at the meeting.
