RECOMMENDATION:

City Council to adopt a resolution authorizing the release of a performance bond collected as part of the Grading Permit for the AutoZone Development Project.

BACKGROUND:

On July 2014, the City of Livingston approved a building permit for the new AutoZone store located within the Rancho San Miguel Commercial Center. As part of the project approvals, the City issued a grading permit for on-site work and an encroachment permit for improvements within the City’s rights of way. As required by the City’s Municipal Code, City staff collected a performance bond from AutoZone Corporation in the amount of $25,000.00 to ensure the completion of all grading work during the construction of the project. AutoZone completed the project in January 2015 and was granted a certificate of occupancy by the City of Livingston shortly thereafter.

DISCUSSION:

AutoZone has requested that the Performance Bond be released from any and all obligations for the project. City staff has inspected the improvements and concurs that the Applicant has fulfilled all the requirements of the project’s Grading Permit including the posting of a performance bond during construction. City staff recommends that the City Council authorize the release of the AutoZone performance bond in the amount of $25,000.00.

FISCAL IMPACT:

There is no fiscal impact associated with this item.

RESOLUTION NO. 2015-

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON AUTHORIZING THE RELEASE OF A PERFORMANCE BOND FOR THE AUTOZONE DEVELOPMENT PROJECT

WHEREAS, City staff approved and issued a Building Permit for the AutoZone Development Project in July 2014; and

WHEREAS, as part of the project approvals, the City issued a Grading Permit for on-site work and an Encroachment Permit for project improvements within the City’s rights of way; and

WHEREAS, in accordance with the City’s Municipal Code, City staff collected a Performance Bond as part of the grading permit to ensure the completion of all grading work during construction of the project; and

WHEREAS, AutoZone Corporation posted a performance bond in the amount of $25,000.00 and now that the project is completed has requested that the bond be released from any and all obligations for the project; and

WHEREAS, City staff has inspected the project improvements and concurs that the Applicant has fulfilled all the requirements of the project’s Grading Permit including the posting of a performance bond during construction.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Livingston hereby:

1. Adopts a Resolution authorizing the release of the AutoZone performance bond in the amount of $25,000.00 dated September 5, 2014.
