AGENDA ITEM: Denial of Claim for Damages from Jason Garcia

RECOMMENDATION:

Staff recommends that the City Council (1) deny the claim for damages from Jason Garcia; (2) submit the claim to AIMS, the City’s insurance adjustors for review and processing; and (3) direct the City Attorney to send a letter to the claimant advising of the City’s denial of the claim.

BACKGROUND:

On February 4, 2011, the City received a claim from Jason Garcia alleging damages sustained to his vehicle located at 942 Topaz Way, Livingston involving the Livingston Public Works Department.

DISCUSSION:

Mr. Garcia alleges that due to negligence damage was done to his vehicle while driving on Stefani Street causing his front and rear wheels on the passenger side to bend plus causing one tire to blow after impact with a pot hole.

FISCAL IMPACT:

After review of the claim by AIMS, the fiscal impact to the City, if any, would be minimal.
