RECOMMENDATION:

Adopt Resolution No. 2016-_, a Resolution of the City Council of the City of Livingston Confirming the Canvass by the Merced County Clerk of the Results of the General Municipal Election of November 8, 2016, Held in and for the City of Livingston and Declaring the Results of Said Election.

BACKGROUND:

In 1971, the City of Livingston requested that the Merced County Board of Supervisors allow the Merced County Clerk to conduct elections for the City of Livingston as permitted by Section 10403 of the California Elections Code.

DISCUSSION:

As of the drafting of this resolution, the top three vote getters are Juan Aguilar, Jr., Wapinder Kang, and Arturo Sicairos.

The City is still waiting for the final canvassing of the votes. Staff expects to receive the final vote count prior to the meeting and will have an updated resolution for the Council meeting.

Adoption of this resolution will finalize the City Municipal Election and facilitate the installation of Mayor-elect, Council Members-elect, City Clerk-elect, and City Treasurer-elect.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON CONFIRMING THE CANVASS BY THE MERCED COUNTY CLERK OF THE RESULTS OF THE GENERAL MUNICIPAL ELECTION OF NOVEMBER 8, 2016, HELD IN AND FOR

THE CITY OF LIVINGSTON AND DECLARING THE RESULTS OF SAID ELECTION

WHEREAS, the City of Livingston by Resolution No. 71-39, requested that the Merced County Board of Supervisors allow the Merced County Clerk to conduct elections for the City of Livingston as permitted by the California Elections Code; and

WHEREAS, there was one full-time Mayor, three full-time Council Members, one full-time City Clerk, and one full-time City Treasurer to be elected; and

WHEREAS, the Merced County Clerk did so conduct the General Municipal Election in and for the City of Livingston on November 8, 2016; and

WHEREAS, notice of said election was given, voting precincts designated, precinct boards appointed, election supplies furnished and votes cast; and

WHEREAS, the Merced County Clerk did, on , certify to this Council the results of her official canvass of the votes cast at said election, which said certification is now on file in the office of the City Clerk of the City of Livingston.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. Said General Municipal Election was duly and legally held and conducted on November 8, 2016, in all respects in the form and manner required by the general laws of the State of California providing for and regulating said Municipal Elections.

2. Said canvass and certification by the Merced County Clerk and the results of said election are hereby confirmed by the Merced County Clerk.

3. The names of persons voted for, the names of the offices for which they were voted, and the number of votes received by each are as follows:
