RECOMMENDATION:

Staff recommends that the City Council (1) deny the claim for the loss of spouse from Balbir Kaur Dhami; (2) submit the claim to AIMS, the City’s insurance adjustors for review and processing; and (3) direct the City Attorney to send a letter to the claimant advising of the City’s denial of the claim.

BACKGROUND:

On May 18, 2016, the City acknowledged receipt of a claim filed by Srai Law Office on behalf of Balbir Kaur Dhami in connection with the death of her husband Bagicha Singh on December 9, 2015.

According to the claim Mr. Singh was walking east across Hammatt Avenue when he was struck and killed by a vehicle. The claimant’s theory of liability against the City of Livingston was that the street light was not working at the time of the accident.

DISCUSSION:

Mrs. Dhami alleges that the Livingston Public Works Department failed to keep the street light at Hammatt and Walnut Avenue in good working order.

FISCAL IMPACT:

After review of the claim by AIMS, the fiscal impact to the City, if any, would be minimal.
